Certain commercial, contracting, licensing, billing, or payment-related operations may also be carried out by Scalehat LLC, 4291 S. Tamiami Trail, 1063, Venice, FL 34293, United States.
These Terms of Service (“Terms”) govern your access to and use of our website, dashboard, proxy infrastructure, APIs, software, tools, and related services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
Services
FloppyData provides proxy and data access infrastructure services, including but not limited to residential, datacenter, mobile, and ISP proxy products, related connectivity tools, and supporting software features. We may modify, suspend, or discontinue any part of the Service at any time.
Eligibility and Account Responsibility
You are responsible for all activity conducted through your account, credentials, API keys, or assigned proxy access. You must provide accurate information, keep your credentials confidential, and notify us immediately of any unauthorized access or suspected misuse.
Acceptable Use Policy
You may use the Service only in compliance with these Terms and all applicable laws, regulations, and third-party rights. You may not use the Service for, facilitate, promote, or assist in any of the following:
a) any illegal, fraudulent, deceptive, or misleading activity;
b) infringement of intellectual property, privacy, publicity, confidentiality, or data protection rights;
c) distribution of malware, spyware, ransomware, malicious code, exploits, or other harmful software;
d) phishing, spam, credential theft, unauthorized access, hacking, intrusion attempts, or security evasion;
e) denial-of-service activity, abusive automation, or conduct that disrupts networks, systems, websites, applications, or services;
f) impersonation, misrepresentation of identity, false affiliation, fake account creation, or deceptive commercial practices;
g) ad fraud, click fraud, fake traffic generation, fake engagement, fake leads, fake account creation, fake impressions, fake installs, fake conversions, or any conduct intended to manipulate metrics, rankings, reviews, platform signals, or advertising systems;
h) circumvention of rate limits, access controls, geoblocks, bans, paywalls, or technical restrictions where such circumvention violates law or contractual restrictions;
i) collection, processing, or scraping of personal data in violation of applicable law, website terms, or platform rules;
j) use of the Service in a manner that violates the terms, policies, or rules of third-party websites, applications, marketplaces, social networks, advertising platforms, or online services;
k) social media abuse, account farming, mass account registration, account takeover, ban evasion, or automation intended to violate platform integrity rules;
l) resale, sublicensing, sharing, or redistribution of the Service except where expressly authorized by us in writing;
m) any use that creates legal, regulatory, reputational, or network risk for FloppyData, its infrastructure providers, payment partners, or other users.
You are solely responsible for ensuring that your use case is lawful and compliant. We do not authorize, endorse, or permit any use of the Service that violates applicable law or third-party platform rules.
Monitoring, Enforcement, and Suspension
We may investigate suspected misuse and may suspend, restrict, or terminate access to the Service immediately, with or without notice, if we reasonably believe that you have violated these Terms, created risk for us or others, or used the Service in a prohibited manner. We may also cooperate with law enforcement, regulators, injured third parties, and service providers where required or appropriate.
Payments and Billing
All fees are due under the pricing and billing terms presented at the time of purchase. Payments may be processed by third-party providers such as Stripe, Cryptomus, Paddle, Unlimit, or other payment partners. We do not store full payment card information ourselves. We may change pricing, packaging, usage limits, subscription terms, or billing structures at any time to the extent permitted by applicable law.
Refund Policy
We may consider a refund only if all of the following conditions are met:
Time and payment:
no more than 3 calendar days have passed since the payment;
the payment was not made in cryptocurrency;
the request applies only to the most recent payment.
Usage:
less than 1 GB of traffic has been used.
Refund history:
no previous refund has been issued to the same customer or account.
Service issue and proof:
the Service did not materially perform as described due to a verified issue on our side; and
you provide sufficient supporting evidence, such as screenshots, logs, video, or other technical proof.
All refund decisions are made at our sole discretion after review. Approved refunds may take up to 10 business days to process.
Third-Party Platforms and Websites
Your use of the Service with or in connection with any third-party platform, website, application, marketplace, social network, search engine, advertising network, or data source is solely your responsibility. You must independently review and comply with that third party’s terms, policies, and legal requirements. FloppyData is not responsible for any claims, restrictions, suspensions, losses, or damages arising from your interaction with third-party services.
Intellectual Property
All content, software, technology, branding, dashboards, interfaces, documentation, and materials made available through the Service are owned by FloppyData or its licensors and are protected by applicable intellectual property laws. Except for the limited right to use the Service in accordance with these Terms, no rights are granted to you.
Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or uninterrupted operation. We do not guarantee that the Service will be error-free, uninterrupted, compatible with every use case, or accepted by any third-party platform.
Limitation of Liability
To the maximum extent permitted by law, FloppyData, FLOPPYDATA – FZCO, Scalehat LLC, and their officers, directors, employees, contractors, affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, contracts, customers, or anticipated savings, arising out of or related to the Service or these Terms, even if advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to the Service shall not exceed the amount paid by you to us for the Service during the 3 months preceding the event giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless FLOPPYDATA – FZCO, Scalehat LLC, and their affiliates, officers, directors, employees, contractors, licensors, infrastructure providers, and payment partners from and against any claims, demands, actions, investigations, liabilities, damages, judgments, settlements, penalties, fines, costs, and expenses, including reasonable legal fees, arising out of or related to:
a) your use or misuse of the Service;
b) your violation of these Terms;
c) your violation of any law, regulation, or third-party right;
d) your use of the Service in connection with any third-party platform or website;
e) any content, data, instructions, targets, destinations, or activities submitted, initiated, or enabled by you through the Service.
Termination
You may stop using the Service at any time. We may suspend or terminate your access at any time if we believe you have breached these Terms, created risk, failed to pay fees, or exposed us or others to legal, financial, operational, or reputational harm. Clauses that by their nature should survive termination will survive, including payment obligations, disclaimers, limitations of liability, and indemnification.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws determined by the contracting entity identified in your order, invoice, or checkout flow, unless otherwise required by applicable mandatory law. We may specify the relevant contracting entity and governing law in the applicable order, invoice, or payment documentation.
Changes to Terms
We may update these Terms from time to time. Updated Terms become effective when posted on the website, unless stated otherwise. Continued use of the Service after the effective date of revised Terms constitutes acceptance of the revised Terms.
